Effective January 1, 2025, Public Act 103-929 was enacted by the Illinois General Assembly. This Act changed the Illinois Municipal Code to make it mandatory that the Chief of Police of a municipal police department must order immediate reinstatement of a police officer upon certification by the Police Pension Board that an officer is no longer disabled and able to resume the duties of his or her position in the police department.
The Act also requires that the officer be reinstated to the same rank or grade held at the date the officer was placed on disability pension under Article 3 of the Illinois Pension Code. This legislation closes a long standing open question as to whether a police department was required to reinstate an officer once a pension board made a determination that an officer was no longer disabled.
